Terms of Service

Welcome to IndiaSkil ("IndiaSkil", "we", "us", "our"). By accessing or using our website, mobile experiences, APIs, and related services (collectively, the "Service") you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account.

2. Nature of the Service

IndiaSkil is a neutral technology platform that connects job seekers and employers, including through automated tools such as profile-based job matching, auto-apply, AI-assisted resumes, cover letters and chat. IndiaSkil is not an employer, recruiter, staffing agency or party to any employment relationship between users.

3. User content & licenses

You retain ownership of the content you upload (resumes, job descriptions, messages, company information, etc.). By submitting content you grant IndiaSkil a worldwide, royalty-free, sublicensable license to host, store, reproduce, transmit, display, adapt and process that content for the purpose of operating, securing, improving and promoting the Service, including training internal matching and ranking models on aggregated or de-identified data.

4. Acceptable use

You agree not to misuse the Service, including by: posting false, misleading, discriminatory, unlawful or fraudulent content; scraping, reverse-engineering, or interfering with the Service; using the Service to spam, harass, or harvest data; circumventing access controls, billing or rate limits; or violating any applicable law. 5. Auto-apply & AI features

When you enable auto-apply, you authorize IndiaSkil to submit applications, cover letters and profile information on your behalf to jobs we determine are a reasonable match. Matching is algorithmic and provided "as is" — we do not guarantee accuracy, interviews, offers, hires, or any specific outcome. AI-generated content (resumes, cover letters, summaries) may contain errors; you remain solely responsible for reviewing and submitting it.

6. Subscriptions & fees

Paid features (including auto-apply for seekers and employers) are billed monthly at the price displayed on the subscription page at the time of purchase. Prices are set and may be updated by IndiaSkil at our sole discretion. Subscriptions are activated by an administrator after receipt of payment confirmation. All fees are non-refundable except as expressly stated in our Refund Policy.

7. Intellectual property

The Service, including all software, design, branding, text, graphics and underlying models, is owned by IndiaSkil and its licensors and is protected by intellectual property laws. You receive only a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Termination

We may suspend, restrict or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms, risk to other users, or operational, legal or security reasons. You may stop using the Service at any time.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability or that the Service will meet your requirements or be error-free. We do not warrant any job, candidate, employer, or third-party content available through the Service.

10. Limitation of liability

To the maximum extent permitted by law, IndiaSkil, its administrators, employees, contractors and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, employment, business opportunity, goodwill or reputation, arising out of or related to your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the fees you paid to IndiaSkil in the three (3) months preceding the claim or (b) ₹1,000.

11. Indemnity

You agree to indemnify and hold harmless IndiaSkil and its administrators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or applicable law.

12. Changes

We may modify these Terms at any time. Material changes will be communicated through the Service. Continued use after changes become effective constitutes acceptance.

13. Governing law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the competent courts located in the city of IndiaSkil's registered office.

14. Dispute resolution & class-action waiver

Any dispute, claim or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith written negotiation for at least sixty (60) days. If unresolved, disputes shall be referred to and finally resolved by arbitration by a sole arbitrator appointed by IndiaSkil, conducted in English, seated in the city of IndiaSkil's registered office, under the Arbitration and Conciliation Act, 1996. You agree to bring claims only in your individual capacity and waive any right to participate in a class, collective, consolidated or representative action.

15. Force majeure

IndiaSkil shall not be liable for any delay, failure, downtime, data loss or non-performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, government action, network or power outages, third-party service provider failures, cyber-attacks, or changes in law.

16. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. IndiaSkil may assign these Terms at any time, including in connection with a merger, acquisition, reorganization or sale of assets, without notice or consent.

17. Severability & waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

18. Entire agreement

These Terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy, Disclaimer and Cookies Policy, constitute the entire agreement between you and IndiaSkil and supersede all prior agreements, representations and understandings, whether written or oral, relating to the Service. No oral statement, email or chat by any IndiaSkil employee, contractor or administrator shall modify these Terms.
